OVERVIEW
Welcome, traveler. You are entering the Futhark marketplace, operated by Snakebite LLC (“Futhark,” “we,” “us,” “our”). Our wares include enchanted gaming tools, mystical accessories, and other goods crafted for adventurers of all realms (the “Services”). Shopify powers the underlying magic (hosting), but all purchases and obligations are between you and Snakebite LLC alone.
By browsing or using our Services, you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, you must leave the marketplace immediately.
SECTION 1 — ACCESS AND ACCOUNT
By using the Services, you confirm that you are of legal age in your region and that any younger apprentices using your devices do so with your permission.
You must provide accurate information, protect your account like a prized relic, and refrain from transferring or selling it.
SECTION 2 — OUR PRODUCTS
We strive to depict our items faithfully, but even the clearest scrying crystal (your screen) may render colors differently.
We do not warrant that any artifact will meet your exact expectations. Product descriptions, availability, and quantities may change at any time without notice.
SECTION 3 — ORDERS
Placing an order is an offer; acceptance occurs only when Snakebite LLC confirms it and processes your payment.
We may refuse, cancel, or adjust orders at our discretion. If we do, we will attempt to contact you using the information you provided.
All returns and exchanges follow our Refund Policy.
You also agree that your purchases are for personal or household use — not resale.
SECTION 4 — PRICES AND BILLING
Prices may shift without notice. Taxes, duties, and shipping costs are separate unless stated.
You agree to provide accurate payment details and authorize us to charge your chosen method for all costs associated with your order.
SECTION 5 — SHIPPING AND DELIVERY
Delivery timelines are estimates only. We are not responsible for delays caused by carriers, customs, or forces beyond our control.
Risk of loss transfers to you once we hand items to the carrier, to the extent permitted by law.
SECTION 6 — INTELLECTUAL PROPERTY
All text, images, artwork, product designs, and other content within the Services are the property of Snakebite LLC or our licensors.
You may not copy, distribute, modify, create derivative works, or reproduce our works without written permission.
All trademarks — including Futhark — belong to Snakebite LLC. Shopify’s marks belong to Shopify. Other marks belong to their rightful owners.
SECTION 7 — OPTIONAL TOOLS
You may encounter third-party tools embedded in the Services. These are provided “as is,” without warranties or assurances. Use them at your own risk.
New features added in the future are also governed by these Terms.
SECTION 8 — THIRD-PARTY LINKS
The Services may contain portals to other realms (external websites). These realms are beyond our control. We do not examine, endorse, or guarantee their contents.
Access them at your own risk.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
Shopify powers the infrastructure but is not a party to your purchases.
All transactions, obligations, and liabilities are solely between you and Snakebite LLC.
You expressly release Shopify from all claims arising from your dealings with us.
SECTION 10 — PRIVACY POLICY
Your personal information is governed by our Privacy Policy and Shopify’s Privacy Policy. You agree to these policies, including international data transmission, when using the Services.
SECTION 11 — FEEDBACK
If you submit reviews, ideas, or other content (“Feedback”), you grant Snakebite LLC a perpetual, worldwide, royalty-free, sublicensable license to use, publish, modify, or display it for any purpose.
You represent that:
- You own the necessary rights to your Feedback.
- It violates no laws or third-party rights.
- It contains no harmful code or deception.
We may remove inappropriate Feedback at our discretion.
SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS
Information on the Services may contain typographical or factual errors. We may correct or update information, or cancel orders, without prior notice.
SECTION 13 — PROHIBITED USES
You agree not to use the Services for unlawful or harmful purposes, including but not limited to:
- violating laws or regulations
- infringing intellectual property
- harassment or abuse
- transmitting malware
- spamming
- scraping or crawling the site
- circumventing security measures
Violations may result in immediate termination of access.
SECTION 14 — TERMINATION
We may terminate or suspend your access to the Services at any time, with or without notice.
Sections that by nature survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification) will continue to apply.
SECTION 15 — DISCLAIMER OF WARRANTIES
Except where required by law, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied.
Your use of the Services and products is at your own risk.
SECTION 16 — LIMITATION OF LIABILITY
To the fullest extent permitted by law, Snakebite LLC, Futhark, our officers, employees, partners, and Shopify shall not be liable for indirect, incidental, punitive, or consequential damages arising from your use of the Services or purchased products.
Some jurisdictions restrict such limitations, so parts of this section may not apply to you.
SECTION 17 — INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Snakebite LLC, Shopify, and our affiliates from claims arising from:
- Your breach of these Terms;
- Your violation of laws or third-party rights;
- Your use of the Services.
We may control the defense at your expense.
SECTION 18 — SEVERABILITY
If any provision of these Terms is deemed unenforceable, the remaining provisions remain in full effect.
SECTION 19 — WAIVER; ENTIRE AGREEMENT
Failure to enforce a right is not a waiver.
These Terms constitute the entire agreement between you and Snakebite LLC regarding your use of the Services.
SECTION 20 — ASSIGNMENT
You may not assign your rights under these Terms without written permission.
We may assign them freely.
SECTION 21 — GOVERNING LAW
These Terms are governed by the laws of the jurisdiction where Snakebite LLC is headquartered. You consent to exclusive venue in those courts.
SECTION 22 — HEADINGS
Headings exist only for readability and do not affect interpretation.
SECTION 23 — CHANGES TO THESE TERMS
We may update these Terms at any time. Changes are effective upon posting. Continued use of the Services constitutes acceptance of the revised Terms.
